Key terms and how to read them

How capitalized words work

A word that starts with a capital letter has the meaning given to it below. Each defined word means the same thing in the singular and in the plural.

What the terms mean

Throughout these Terms and Conditions:

• Affiliate means an entity that controls a party, is controlled by a party, or is under common control with a party. Here, "control" means owning 50% or more of the shares, equity interest or other securities that carry the right to vote in the election of directors or other managing authority.
• Country means Morocco.
• Company means ZynTV, which this Agreement also calls "We", "Us", "Our" or "the Company".
• Device means any device able to access the Service, for example a cellphone, a digital tablet or a computer.
• Service means the Website.
• Terms and Conditions (also called "Terms") means these Terms and Conditions, which make up the entire agreement between the Company and You about use of the Service.
• Third-party Social Media Service means any services or content (including data, information, products or services) that a third party provides and that the Service may display, include or make available.
• Website means ZynTV, which can be reached at https://www.zyntv.com/
• You means, as applicable, the individual who accesses or uses the Service, or the company or any other legal entity on whose behalf that individual accesses or uses the Service.

Agreeing to these terms

These Terms govern use of this Service. They are also the agreement that applies between You and the Company. They set out the rights and obligations every user has in relation to using the Service.

You may access and use the Service only on condition that You accept and comply with these Terms. They apply to all visitors, users and anyone else who accesses or uses the Service.

When You access or use the Service, You accept that these Terms bind You. If You disagree with any part of them, You are not permitted to access the Service.

You represent that you are over 18 years old. The Company does not allow anyone under 18 to use the Service.

You may access and use the Service only if You also accept and comply with the Company's Privacy Policy. That Privacy Policy sets out Our policies and procedures for collecting, using and disclosing Your personal information when You use the Application or the Website. The Company does not control, and takes no responsibility for, the content, privacy policies or practices of any third-party web sites or services. You also acknowledge and agree that We will not be responsible or liable, whether directly or indirectly, for any damage or loss that is caused, or alleged to be caused, by or in connection with using or relying on any content, goods or services made available on or through those web sites or services.

We strongly recommend that You read the terms and conditions and privacy policies of every third-party web site or service You visit.

Ending or suspending access

We may suspend or terminate Your access at once, for any reason at all, without giving notice first and without liability. This includes, without limitation, if You breach these Terms.

On termination, Your right to use the Service will end straight away.

Limits on our liability

Whatever damages You might incur, the total liability of Us and any of Our suppliers under any provision of these Terms, and Your exclusive remedy for all of the above, are limited to the amount You actually paid through the Service, or to 100 USD if You have not bought anything through the Service.

As far as applicable law allows, neither We nor Our suppliers will in any event be liable for any special, incidental, indirect or consequential damages of any kind. That includes, but is not limited to, damages for lost profits, lost data or other information, business interruption, personal injury, or loss of privacy arising out of or in any way related to the use of, or inability to use, the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms. This applies even if We or any supplier has been told that such damages are possible, and even if the remedy fails of its essential purpose.

Some states do not let implied warranties be excluded, or liability for incidental or consequential damages be limited, so some of the limitations above may not apply. In those states, each party's liability will be limited as far as the law permits.

The Service is provided "AS IS" and "AS AVAILABLE"

The Service comes to You "AS IS" and "AS AVAILABLE", with all faults and defects, and with no warranty of any kind. As far as applicable law allows, We expressly disclaim every warranty about the Service, whether express, implied, statutory or otherwise. We do so on Our own behalf and on behalf of Our Affiliates and Our and their respective licensors and service providers. This includes all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limiting the above, We give no warranty or undertaking, and make no representation of any kind, that the Service will run without interruption, be error free, meet Your requirements, meet any performance or reliability standards, achieve any intended results, or be compatible or work with any other software, applications, systems or services. We also give no such warranty, undertaking or representation that any errors or defects can or will be corrected.

Also without limiting the above, neither We nor any of Our providers make any representation or warranty of any kind, express or implied: (i) about the operation or availability of the Service, or the information, content, and materials or products included on it; (ii) that the Service will be uninterrupted or error-free; (iii) about how accurate, reliable or current any information or content provided through the Service is; or (iv) that the Service, its servers, the content, or e-mails sent from Us or on Our behalf are free of malware, viruses, worms, trojan horses, timebombs, scripts or other harmful components.

Some jurisdictions do not let certain types of warranties be excluded, or a consumer's applicable statutory rights be limited, so some or all of the exclusions and limitations above may not apply to You. In that case, the exclusions and limitations in this section will still be applied as far as applicable law makes them enforceable.

Which law applies

These Terms and Your use of the Service are governed by the laws of the Country, excluding its conflicts of law rules. Other local, state, national or international laws may also apply to Your use of the Application.

Resolving disputes

If You have a concern or dispute about the Service, You agree that Your first step will be to contact Us and try to resolve the dispute informally.

Users in the European Union (EU)

If You are a European Union consumer, you will have the benefit of any mandatory provisions in the law of the country where You are resident.

United States legal requirements

You represent and warrant that: (i) You are not located in a country that is under a United States government embargo, or that the United States government has designated as a "terrorist supporting" country; and (ii) You do not appear on any United States government list of prohibited or restricted parties.

Invalid provisions and waivers

If a provision cannot be enforced

If a provision of these Terms is held invalid or unenforceable, it will be changed and interpreted to achieve that provision's objectives as fully as applicable law allows. All other provisions will remain in full force and effect.

Not enforcing a right

Except as these Terms provide, not exercising a right, or not requiring an obligation to be performed, under these Terms does not affect a party's ability to exercise that right or require that performance at any later time. Waiving a breach also does not amount to waiving any later breach.

Translations

If We have made these Terms available to You on our Service, they may have been translated. If there is a dispute, You agree that the original English text prevails.

When these terms change

We may modify or replace these Terms at any time, at Our sole discretion. For a material revision, We will make reasonable efforts to give at least 30 days' notice before any new terms take effect. We decide what counts as a material change, at Our sole discretion.

If You keep accessing or using Our Service once those revisions take effect, You accept the revised terms and are bound by them. If You disagree with all or part of the new terms, please stop using both the website and the Service.
